Removal of menu bar here - is the first option available to you? If not try......

  1. Go to HKEY_CURRENT_USER\Software\Microsoft\Windows\CurrentVersion\Explorer\Advanced
  2. Delete AlwaysShowMenus, or set it to zero
  3. Delete the entry and reboot

those are the default values

try to remove your custom theme, then remove the menu bar and then reapply your theme. may just be glitched with that custom theme applied
