He can be sued, you can file a law suit over anything.

The issue is can the business win and it's going to be difficult. Given how they installed software that the customer didn't ask for the customer can claim it was Spyware.

To me, as a business you never install software without telling the customer.

I think we’re lost. The only person that has to prove anything is the one being sued. You can’t make libel claims without proof.
All the business has to say is that they didn't install the software and the defaming claim has caused damages.

In Australia, a plaintiff only needs to prove that the material published by the defendant contained one or more defamatory claim. That’s pretty easy here now. The person being sued has to prove that what they said is substantiated, if they say “This software was on my computer when I got home” I don’t believe that’s going to cut it.

In this case, the op not only doesn’t know where the app came from, they falsely believed it was an app that “scans for spam and scams”
It’s an email app. He’s probably failed already.

It would be different if they knew how to check logs to see exactly when it was installed and could prove it was during the time that the techs had the PC, but by the time a defamation hearing came about, I’m going to wager that this information is long gone, in fact it is already.

So getting online and bagging a business “in this case” could get you sued.
